Libraries operate WITHOUT the permission of copyright holders. This has always been the case. Even back in the day of Ben Franklin's library company.

This is possible because libraries buy or receive legally made copies. As such they become the OWNER of these particular copies and can rent, lease, lend, or resell them just as with any other piece of their property. (section 109)

The same is true of movie rental companies They operate on the same legal principles as car rental companies. Each buys a piece of property and with it gains the property rights that go with it.

Therefore, video stores can choose to rent, lease, lend, or resell their tapes and DVDs just as a library can.

In addition, libraries have their own specifically legislated exemptions from some bits of copyright law. (section 108)
